Dealing with debt collection agencies can be a nightmare for most ordinary consumers. Nearly everyone has at some point had to deal with debt collectors and nearly everyone agrees that it can be a nightmare process. Today, after credit card companies and others altered their lending practices, many trustworthy individuals have been placed in a situation where they are laden with debt.

Unfortunately, many people feel that they are in some way a “bad” person because they find themselves in debt. Dealing with credit card and other debt need not make one feel guilty and the key to dealing with collection agencies is to take an even handed and fair-minded approach to the proceedings.

The good news is that there are people out there who can help people who are in debt. In fact, there are many things that you yourself can do to make a bad situation better. The first step is to educate yourself. There are so many opportunities today for debt collectors and collection agencies to take advantage of regular people who find themselves in debt.

This situation is not fair and you don’t have to accept the threatening phone calls and letters. You are not a bad person because of predatory lenders which are getting rich off of your interest payments. And there are many organizations that are useful in helping ordinary people fight back. The key is to assert your rights and to get help with debt when before you get too far behind.

The first thing that you need to be aware of is the fact that you have rights. Regardless of the intimidation tactics that a debt collector tries to use to get you to pay for an outstanding credit card debt, an old medical bill or even a car loan, knowing your rights will have you balance the scales and get an outcome that is fair for all parties.

The fact is that collection agencies rely on your fear. Many people fear that they will have their wages garnished or even be put in jail because of unpaid debts. Therefore they ignore calls and letters and hope that the situation will simply go away. This is probably the worst thing you can do when dealing with debt collection agencies. Most consumer credit counselors, who are the real experts (and people on your side) when it comes to these calls and letters recommend that you deal with the situation honestly and truthfully. By confronting the situation you are able to better diffuse it before it grows into a bigger problem.

The government is well aware of the problem of collection agencies and their unscrupulous methods to get people to pay up. Most debt collectors break the law regularly by threatening people, intimidating them with saying that they are committing a crime and even impersonating lawyers and law enforcement. The fact of the matter is that the US government established a law to provide ordinary people with a defense against these types of collectors.

This law is known as the Fair Debt Collection Practices Act also called the FDCPA. The FDCPA provides certain rules that collection agencies must follow when trying to collect a debt. It is important that you take the time to become familiar with these provisions. The key is to educate yourself about the rights that you have as a citizen. With that information you will be better able to take the appropriate action.
